Bismarck police responded to a residence on Oct. 26 following a 911 call. After arriving, they arrested and charged a 54-year-old man for attempted murder.

According to law enforcement officers, the man and a 47-year-old woman had been arguing over a car title. Allegedly, he began beating and strangling her. The woman claimed she then attempted to give the title to the man before trying to call the police. She and a 21-year-old female witness who tried to help said he then grabbed a knife and held it to the older woman’s throat.

Responding officers reported that they had to forcibly remove the man and the knife away from the woman. The witness told police that she was the one who had called 911 and that she had jumped on the man in an effort to stop him from harming the older woman. In addition to attempted murder, the man also faces charges of interfering with a 911 call and preventing arrest.

While police may arrest a person suspected of committing criminal offenses, the actual decision regarding the charges the person may face will be made by a prosecutor. People who are accused of crimes, including violent crimes and domestic violence, have a constitutional right to present a defense to the charges. Even in cases in which a person did commit a crime, he or she may still benefit by seeking the representation of a criminal defense attorney. A defense attorney may be able to devise a good defense strategy to the charges or negotiate a plea to a lesser offense than the initial charge.
