Child Pornography Is An Extremely Serious Allegation

Child pornography is aggressively prosecuted throughout the country in both state and federal courts. The penalties for even possessing pornography involving children can be severe, and both fines and prison sentences increase substantially when charges involve sharing or producing the content.

At Dusek Law, a criminal defense law firm, we believe that all our clients deserve an aggressive defense that protects their rights and helps them clear their names. From our offices in East Grand Forks, we represent clients throughout North Dakota and Minnesota, offering them zealous advocacy in these difficult cases.

Lawyers Defending Clients Against Internet Sex Crimes

As technology evolves, methods of solicitation, creation and dissemination of pornographic materials have changed greatly. Offenses involving sexting and internet luring make it critical that a defendant have a defense attorney who understands how to craft a persuasive defense argument with complex, technology-based evidence. Attorney David Dusek has the extensive investigation and trial experience necessary to advocate for clients in these situations.

Often, sex crimes, such as child pornography charges, are shrouded in secrecy. In fact, many individuals don’t know where images originated or even that they are illegal to possess. At Dusek Law, we take the time to explain to clients the charges against them and their options moving forward. We work closely with them to find the best solutions to mitigate negative consequences and help them move forward.

What Is Considered Child Pornography?

Child pornography is a crime with a specific definition. Often, it is the exact wording of the law on which you can begin to build your defense. In North Dakota criminal code § 12.1-27.2-04.1, the law strictly forbids possession of any “motion picture, photograph or visual representation that includes sexual conduct by a minor.”

In Minnesota, however, the law is slightly different, defining child pornography in § 617.246 as any depiction or original work that includes a performance of sexual acts by minor, whether actual or simulated.

How Long Can You Be Incarcerated For Child Pornography?

As with the previous question, it depends on where you are located and the various circumstances of your charge. However, you do stand to face significant jail time for possession of child porn in both states, as follows:

  • North Dakota penalties: Child porn is listed as a class C felony with a punishment of up to five years in prison as well as a $10,000 fine.
  • Minnesota penalties: A child porn conviction can come with up to five years in prison and a $5,000 fine. However, if it’s a second conviction or the minor is under 14, penalties can increase to 10 years in prison and a $10,000 fine.

Additionally, you should be worried about more than just the legal consequences. Child pornography allegations can upend and destroy your personal and professional lives as well. But, a skilled, confidential defense lawyer may be able to help.
