Immediate consequences for your driver’s license

When you’re arrested for DUI in North Dakota, the consequences for your driver’s license begin right away. If you’re convicted, you can expect a suspension of your driver’s license. The length of the suspension varies depending on factors like whether it’s your first offense, your blood alcohol concentration (BAC), and any prior DUI-related offenses.

For a first offense, your driver’s license may be suspended for 91 days. A second offense could lead to a suspension for 365 days, while a third offense may result in a permanent revocation of your license. It’s important to remember that you may be eligible for a limited driving privilege, or hardship license, in certain cases.

Administrative penalties 

In addition to criminal penalties, the North Dakota Department of Transportation (NDDOT) plays a role in the suspension of your driver’s license. If you fail or refuse a breath test, the NDDOT will automatically initiate a suspension, independent of criminal court outcomes. This administrative penalty can lead to a 180-day suspension for a first refusal and longer for subsequent offenses.

The NDDOT offers a hearing process, which can help reduce the length of your suspension if you act quickly. Requesting this hearing within 10 days of your arrest gives you a chance to challenge the suspension before it becomes final.

Ignition interlock devices

If you’re convicted of a DUI, the state may require the installation of an ignition interlock device (IID) in your vehicle. This device tests your breath before starting the car. If it detects alcohol, the vehicle won’t start. IID requirements can extend the restrictions on your driver’s license, even after your suspension is over.
