What are the punishments for a DUI in North Dakota?

On Behalf of | Oct 9, 2024 | DUI

Driving under the influence is a serious crime in North Dakota, and repeat offenses lead to harsher penalties. Understanding the consequences of multiple DUIs can help you make informed decisions and avoid severe legal trouble.

Second DUI offense penalties

If you receive a second DUI within seven years of the first, the state imposes stricter punishments. You will face at least ten days in jail, with a minimum of 48 hours served consecutively. Fines increase to at least $1,500. Additionally, your driver’s license will be suspended for one year if your blood alcohol concentration (BAC) was below 0.18%. If your BAC was 0.18% or higher, the suspension extends to two years.

Third DUI offense penalties

A third DUI offense within seven years escalates the situation further. You will spend at least 120 days in jail. The minimum fine rises to $2,000. Your license suspension will last for two years if your BAC was below 0.18%, and three years if it was 0.18% or higher. You will also be required to undergo an addiction evaluation and may have to participate in treatment programs.

Fourth and subsequent DUI offenses

A fourth DUI offense within 15 years is classified as a Class C felony. This results in at least one year and one day in prison. Fines remain at a minimum of $2,000, but the court may impose higher amounts. License suspension extends to three years for BAC levels below 0.18% and four years for higher levels. Felony convictions carry long-term consequences, including difficulties finding employment and housing.

Factors that affect penalties

Several factors can influence the severity of the punishments. High BAC levels lead to longer license suspensions and may result in mandatory participation in sobriety programs. Refusing to take a chemical test when stopped by law enforcement adds penalties, such as license revocation. If you had a minor in the vehicle, the court might impose additional charges and harsher sentences.

Repeat DUIs in North Dakota come with increasingly severe punishments that can impact your freedom and future opportunities. Being aware of these penalties underscores the importance of making responsible choices when it comes to drinking and driving.
