Charges filed in alleged North Dakota home burglary

North Dakota law enforcement officials reported on Dec. 13 that two individuals believed to be involved in a home invasion were taken into custody. Two homeowners purportedly suffered injuries in the incident.

The two accused individuals, ages 20 and 21, were allegedly accompanied by a third individual whose identity remains unknown to police. According to officials, the three individuals entered a home on Dec. 7 just before 7 a.m. They reportedly assaulted and robbed the two homeowners of cash and miscellaneous items. After reporting the alleged crime, the two injured homeowners received treatment for their injuries at the scene of the incident.

The two accused individuals taken into custody were charged with Class B Burglary. The case has not been adjudicated, and the two individuals have the right to retain legal counsel and contest the accusations levied against them.

In order to be charged with burglary, individuals must be accused of breaking or entering into an occupied structure without consent for the purpose of committing a crime. Accused individuals may be charged with a Class B felony if law enforcement officials suspect that they inflicted or attempted to inflict bodily harm during the incident. Depending on certain circumstances surrounding the case, charged individuals may face a jail sentence, probation and expensive fines or fees upon conviction.

The best way to avoid such penalties is to employ the professional guidance and resources of a criminal defense attorney. There are several criminal defense strategies the attorney may use to contest charges. If the charges are founded on a lot of strong evidence, the attorney may try to mitigate the potential penalties by negotiating a plea deal with the prosecution.
