Child Pornography Is An Extremely Serious Allegation

Child pornography is aggressively prosecuted throughout the country in both state and federal courts. The penalties for even possessing pornography involving children can be severe, and both fines and prison sentences increase substantially when charges involve sharing or producing the content.

What Is Considered Child Pornography?

Child pornography is a crime with a specific definition. Often, it is the exact wording of the law on which you can begin to build your defense. In North Dakota criminal code § 12.1-27.2-04.1, the law strictly forbids possession of any “motion picture, photograph or visual representation that includes sexual conduct by a minor.”

In Minnesota, however, the law is slightly different, defining child pornography in § 617.246 as any depiction or original work that includes a performance of sexual acts by minor, whether actual or simulated.

How Long Can You Be Incarcerated For Child Pornography?

As with the previous question, it depends on where you are located and the various circumstances of your charge. However, you do stand to face significant jail time for possession of child porn in both states, as follows:

  • North Dakota penalties: Child porn is listed as a class C felony with a punishment of up to five years in prison as well as a $10,000 fine.
  • Minnesota penalties: A child porn conviction can come with up to five years in prison and a $5,000 fine. However, if it’s a second conviction or the minor is under 14, penalties can increase to 10 years in prison and a $10,000 fine.
