State And Federal Agencies Take Fentanyl Crimes Seriously

Fentanyl is a synthetic opioid drug originally used as a pain medication for patients with serious and terminal illnesses. Fentanyl is up to 100 times stronger than heroin and morphine. Because of its extreme potency, a small dose can be lethal. Combined with the high chance of addiction, fentanyl overdoses have increased nationwide.

Because of the rising availability and deadly impacts, federal and state agencies are cracking down on fentanyl crimes. As a schedule II-controlled substance under federal law, it is one of the most serious drugs for which a person can face criminal charges. If you get caught possessing or selling fentanyl, you may face serious consequences.

Under Minnesota and North Dakota state laws, fentanyl is a schedule I substance. It can result in hefty fines and lengthy prison sentences, including:

  • Up to five years in prison
  • Up to a $10,000 fine
  • A felony conviction

If you are charged with a first-degree drug offense, you could even face 40 years in prison and up to a $1,00,000 fine. However, if you are experiencing an overdose after using a drug in Minnesota or North Dakota and you require medical assistance, you will not be charged or prosecuted for possession of the drug. Further, if you call for help for someone else experiencing an overdose, you are also immune to prosecution.
